These Terms of Service and Privacy Policy ("Terms") govern your use of CasaAI ("the Service"), operated by Francesco Calvia, doing business as AutomationAI Solutions ("CasaAI", "we", "us"). By creating an account, starting a trial, or using the Service, you ("Customer", "you") agree to these Terms.
The Service is provided exclusively to businesses for use in their trade or profession. It is not directed to consumers, and you confirm you enter into these Terms in a business capacity. Consumer-protection rules that would otherwise apply to consumer contracts do not apply.
CasaAI is an AI-powered voice assistant ("front desk") that answers inbound telephone calls on your behalf, provides information you configure, schedules tours or appointments, logs maintenance requests, and forwards messages and summaries to you. It is a software communication tool only.
You remain solely responsible for emergency handling, maintenance dispatch, habitability, safety, and all property-management decisions. The Service does not provide legal, financial, fair-housing, or leasing advice and does not make tenancy, screening, pricing, or housing decisions; any such decision is made solely by you. You must maintain an independent means for callers to reach you in an emergency and must not rely on the Service for time-critical or safety-critical matters.
You understand and accept that AI systems are probabilistic and imperfect. The Service may mishear, misunderstand, transcribe or route information incorrectly, provide inaccurate or incomplete responses, or be delayed or unavailable. You accept these limitations as inherent to the Service.
You are solely responsible for the lawful operation of the Service for your business, including: (a) obtaining all legally required consents for call recording and AI interaction, including in two-party / all-party consent jurisdictions; (b) compliance with telemarketing and communications laws (e.g. TCPA); (c) compliance with the U.S. Fair Housing Act, state and local fair-housing laws, the FCRA and applicable tenant-screening laws, the ADA, and all landlord-tenant and licensing laws; and (d) the accuracy and lawfulness of the information you configure the Service to provide. You will configure and use the Service so that it does not make or communicate discriminatory statements or decisions.
You may not use the Service unlawfully, to harass, deceive, or infringe rights, to violate fair-housing or communications laws, or in any way that disrupts the Service or third parties.
Paid plans are billed in advance on a recurring basis through our payment processor. Any free trial (e.g. 7 days / 50 minutes) converts to a paid subscription unless cancelled before it ends. Fees are non-refundable except where required by mandatory law. We may change pricing on prospective notice.
Either party may terminate at any time, effective at the end of the current billing period. We may suspend or terminate immediately for breach, unlawful use, or risk to the Service or third parties.
The Service, software, and all related IP remain ours. You receive a limited, non-exclusive, non-transferable right to use the Service during your subscription. Content you provide remains yours; you grant us the right to process it to provide the Service.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, uninterrupted or error-free operation, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost business, lost or missed calls or leads, reputational harm, or property damage, arising out of or relating to the Service. Our total aggregate liability for all claims is limited to the greater of (a) the fees you paid us in the three (3) months before the event giving rise to the claim, or (b) USD 100. Nothing in these Terms excludes liability that cannot be excluded by mandatory law (including, under Swiss law, liability for unlawful intent or gross negligence under Art. 100 CO).
Any claim arising out of or relating to the Service must be brought within twelve (12) months after the event giving rise to it, failing which it is permanently barred, to the extent permitted by law.
You will defend, indemnify, and hold us harmless from any claim, loss, or liability arising from: your use of the Service; calls handled on your behalf; any emergency, maintenance, tenancy, leasing, screening, or housing matter; lack of required consent; or your breach of these Terms or of any law (including fair-housing, communications, recording-consent, or landlord-tenant laws).
Each party will protect the other's non-public information and use it only to perform under these Terms.
We may modify the Service or these Terms. Material changes will be posted here with a revised effective date; continued use constitutes acceptance.
These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Sarnen, Canton of Obwalden, Switzerland. Disputes are resolved individually; to the extent permitted by law, you waive any right to bring or participate in class or representative actions.

For personal data contained in or arising from calls handled on your behalf (e.g. caller and tenant information), you are the controller and we act as a processor on your instructions. For our own account, billing, and website data, we are the controller.
Account and billing details you provide; the configuration you set up; and call-related data (audio, transcripts, phone numbers, message content) processed on your behalf to deliver the Service. We also process limited website and analytics data.
To provide, operate, secure, and improve the Service, to process payments, and to communicate with you. We do not sell personal data, and we do not use your callers' content to train general AI models.
We rely on reputable providers for telephony, speech/AI, hosting, and payments. Each processes data only to provide its function on our behalf.
Where calls are recorded or transcribed, this is done at your configuration and on your instruction. Obtaining any legally required consent from callers is your responsibility (see Terms §5).
We retain data only as long as needed to provide the Service and as required by law, and apply appropriate technical and organisational measures to protect it. No system is perfectly secure.
Data may be processed in Switzerland, the EU, the United States, and other countries where we or our subprocessors operate, with appropriate safeguards where required.
Requests concerning data we process on a customer's behalf should be directed to that customer (the controller). For data we control, contact us using the details below.
The Service is intended for businesses and is not directed to children; we do not knowingly collect children's data.
We may update this Privacy Policy; updates are posted here with a revised effective date.
